中文摘要
在现代社会科学体系中,"行政裁量"首先是在行政法学中发展出的一个概念,是行政法希望加以约束的对象。在"行政国家"生成的过程中,行政裁量行为迅速增长,从而使行政法逐渐成了政府有效行使裁量权力的障碍。于是,公共行政学开始取代行政法学而承担起了行政裁量的研究任务,并对其作出了更加积极的理论确认。由于行政裁量问题在公共行政研究中的引入,逻辑性地突出了"责任"的主题,学者们就此展开了激烈争论。在争论中,"政治—行政"二分的叙事原则逐渐被"事实—价值"二分的研究取向所取代,从而推动了公共行政学的进化。更为重要的是,在公共行政研究对行政裁量的关注中,发展出了一条不同于行政法学的思路,那就是从伦理的角度出发去思考行政裁量权的规范问题。
