美国独立之初,邦联国会(1781—1789)依照《邦联条例》获得处理对印第安人事务的权力,并在这一领域大显身手。邦联国会所确定的购买和文明同化政策奠定了未来美国政府对印第安人政策的基础。同时,邦联国会在处理对印第安人事务时相对于州的主动和主导地位,又有助于美国早期国家观念的形成。

①1754年的奥尔巴尼联盟方案规定大统领在大议会的建议下,应该控制对印第安人事务;1775年7月21日,他的结盟条例第10条涉及处理印第安人事务问题。未经国会同意或者未经以上提及之委员会同意,任何殖民地不得对任何印第安部落发动攻击,遇有问题,首先应该由国会或者委员会来分析发动这样战争的正义性和必要性。应该尽快与六大部落缔结永久攻守联盟;应该界定它们的边界,并予以保障;不能侵犯它们的土地,所有从私人或者殖民地从它们那里进行的土地购买都不再有效;除非由奥农达加(Onondaga)的印第安部落的大委员会与总体国会之间缔结的契约才能有效;其他任何印第安部落的边界和土地也应该在同样的方式下受到保护;应该任命一些人驻扎于某些地区,由他们负责制止在对印第安人的贸易中对印第安人的不公正行为,以及负责从我们的总体开销中提供一小部分费用,用于减轻他们个人的物资匮乏或者痛苦。而为了合众国政府的福利,对它们进行的所有购买都应该由国会来负责。Worthington Chauncey Ford,ed.,Journals of the Continental Congress,Washington D.C.:Government.print off.,19041937,Vol.2,pp.197-198.
